Hi there, I'm Craig Horvath!


I have spent all of my career working in the bankruptcy field. Bankruptcy is an excellent tool to bring relief for individuals experiencing financial distress. I love helping others and bankruptcy has helped many achieve financial relief. 1) What Type Of Bankruptcy Is Right For Me?

While there are several different options or “chapters” of bankruptcy, everyone will have a unique financial situation. The type of debt relief that is best for you will depend on your debts, assets, and goals. For example, under Chapter 7 Bankruptcy, you may be allowed to discharge part or all of your unsecured debts; however, you may lose some of your property as payments to creditors. Under Chapter 13 Bankruptcy, you are allowed to keep your assets but agree to pay back a portion of your debt over a set period of time. Our legal team can help you understand what is best for you.

2) Will I Be Forced To Give Up My Assets?

You may have heard that when you file for bankruptcy, you will be forced to liquidate your existing assets. However, only with certain options, such as Chapter 7 bankruptcy, will the possibility exist – and even then it is not a certainty. With other routes, such as Chapter 13, individuals are typically allowed to hold on to their property throughout and after a bankruptcy.


3) What Can I Do About Creditor Harassment?

Creditors can be unrelenting in their attempts to collect on debts owed. However, they sometimes cross the line and engage in debtor harassment. What many people may not know is that it is illegal for debt collectors to use harassment as a tactic and can face legal consequences for doing so. If you believe that your rights are being violated by creditors, it is best to speak with an attorney about your situation immediately.

4) How Long Does It Take To File For Bankruptcy?

The amount of time it may take to file for bankruptcy can depend on the type or “chapter” being utilized, the complexity of a person’s situation, and if they have enlisted the help of an attorney. Much of the time-intensive factors of bankruptcy deal with gathering all the needed information and documentation to ensure that the process is completed properly. This can include the disclosure of all debts, assets, and income as well as information about inheritances or gifts within a designated time period.


5) Can I File On My Own?

It is possible to file bankruptcy on your own, but it can be a very complicated process that requires a lot of legal knowledge. Most clients we've had who filed on their own before working with us end up getting their case dismissed because they didn't have an understanding of: assets, income/expenses, Means Test, financial affairs, and more!
